Terms & conditions
These terms and conditions ("terms") govern your access to and use of MailingPlatform, the email marketing service available at mailingplatform.net and app.mailingplatform.net (the "service"). By creating an account or using the service, you agree to be bound by these terms. If you do not agree, do not use the service.

References to "MailingPlatform", "we", "us" and "our" in these terms mean CMC. You can contact us at support@mailingplatform.net.
2. The service
MailingPlatform is a software-as-a-service platform for email marketing. Depending on your plan, the service includes:
- Creation and sending of email campaigns
- Subscriber and list management, segmentation and suppression lists
- Marketing automation workflows and triggered emails
- Email templates, including a drag-and-drop builder and an HTML editor
- Analytics and reporting, including open, click, bounce and unsubscribe tracking
- Website and e-commerce event tracking, including our WooCommerce integration
- Email address validation
- Data import and export tools
We continuously develop the service and may add, change or remove features. Where a change materially reduces the core functionality you pay for, we will give you reasonable advance notice.
3. Accounts and eligibility
You must be at least 18 years old and use the service for business purposes. You agree to provide accurate and complete registration information and to keep it up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@mailingplatform.net if you suspect unauthorised use of your account.
4. Plans, billing and payment
The service is offered on subscription plans as described on our pricing page. Each plan includes limits, such as a maximum number of active subscribers, which are enforced by the service.
- Fees are stated in euro (EUR) and are exclusive of VAT unless stated otherwise. Applicable VAT is added at checkout in accordance with Danish and EU tax rules.
- Payments are processed by Stripe. We do not store your card details.
- Subscriptions renew automatically at the end of each billing period (monthly or yearly) until cancelled.
- If a payment fails, we may retry it and notify you. If payment remains outstanding, we may downgrade, suspend or terminate your account after notice.
We may change our prices. Price changes take effect at the start of your next billing period, and we will give you at least 30 days' notice by email or in-app notification before a price increase applies to you.
5. Cancellation and refunds
You can cancel your subscription at any time in the app under Settings → Subscription, which opens our billing portal. Cancellation takes effect at the end of the current billing period: you keep full access until then, and you are not charged again.
Except where required by mandatory law, fees already paid are non-refundable, including for partially used billing periods.
6. Acceptable use and anti-spam policy
The service may only be used to send email to recipients who have given valid consent to receive it, or where you otherwise have a lawful basis under applicable marketing and data protection law (including the GDPR and the ePrivacy rules). In particular, you agree that you will not:
- Send unsolicited email (spam) of any kind
- Use purchased, rented, scraped or otherwise third-party-sourced address lists
- Remove, hide or disable the unsubscribe mechanism in emails sent through the service
- Continue to email recipients who have unsubscribed or been suppressed
- Send content that is unlawful, fraudulent, deceptive, defamatory, or that infringes third-party rights
- Send phishing, malware or other harmful content
- Misrepresent the sender or origin of a message
- Attempt to probe, disrupt or gain unauthorised access to the service or its infrastructure
- Resell or provide the service to third parties without our written consent
Every marketing email sent through the service must include a functioning unsubscribe link and truthful sender identification. The service adds and enforces unsubscribe handling automatically; you must not circumvent it.
We monitor aggregate delivery metrics such as bounce and complaint rates. If your sending harms or is likely to harm deliverability for the platform, we may throttle, pause or block your sending and require corrective action. Serious or repeated violations of this section may lead to immediate suspension or termination.
7. Your content and data
You retain all rights to the content you create and the data you upload to the service, including your subscriber lists ("customer data"). You grant us a limited licence to host, process and transmit customer data solely to provide and support the service.
You are responsible for the legality of the customer data you upload and the content you send, including having a valid legal basis for processing your subscribers' personal data.
You can export your subscriber data at any time using the built-in export tools. Export download links are valid for 7 days.
8. Data protection
For personal data in your subscriber lists, you are the data controller and we act as your data processor. Our processing of personal data is described in our privacy policy and our GDPR compliance page.
9. Intellectual property
The service, including its software, design, templates and documentation, is owned by CMC or its licensors and is protected by intellectual property law. These terms do not grant you any rights to the service other than the limited right to use it in accordance with these terms while your subscription is active.
You may not copy, modify, reverse engineer or create derivative works of the service, except to the extent permitted by mandatory law.
10. Third-party services and integrations
The service integrates with third-party services, such as Stripe for payments, Amazon Web Services for email delivery, and e-commerce platforms such as WooCommerce. Your use of a third-party service is governed by that third party's own terms. Where you connect your own third-party accounts or credentials (for example an e-commerce store), you are responsible for your compliance with the third party's terms, and you authorise us to exchange data with that service on your behalf to provide the integration.
11. Availability and support
We aim to keep the service available at all times but do not guarantee uninterrupted availability. We may perform maintenance, updates and emergency fixes, and will where practicable schedule planned maintenance outside peak hours.
Support is provided in-app and by email at support@mailingplatform.net. Parts of our support are AI-assisted; you can always request a human follow-up.
12. Suspension and termination
We may suspend or terminate your access to the service, in whole or in part, if:
- You materially breach these terms, including the acceptable use policy in section 6
- Your payment is overdue after notice
- We are required to do so by law or by an order of a competent authority
- Your use poses a security, legal or deliverability risk to the service or other customers
Where reasonable, we will notify you and give you an opportunity to remedy the issue before suspension or termination takes effect.
You may terminate your account at any time by cancelling your subscription and deleting your account in the app. Upon termination, your right to use the service ends. We recommend that you export your data before closing your account; after account deletion, your customer data is deleted from our production systems, and residual copies in encrypted backups are removed automatically on a rolling basis.
13. Disclaimers
The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be error-free, that defects will be corrected, or that any particular delivery, inbox placement or marketing result will be achieved.
14. Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, special or consequential damages, including loss of profits, revenue, goodwill or data.
- Our total aggregate liability arising out of or relating to the service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim.
Nothing in these terms limits liability that cannot be limited under applicable law, including liability for gross negligence or wilful misconduct.
15. Indemnification
You agree to indemnify and hold us harmless from claims, damages and reasonable costs (including legal fees) arising from your customer data, your sending practices, your breach of these terms, or your violation of applicable law.
16. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you by email or in-app notification at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated terms. If you do not accept the changes, you may cancel your subscription before they take effect.
17. Governing law and venue
These terms are governed by Danish law, without regard to its conflict of law rules. Any dispute arising out of or in connection with these terms or the service shall be brought before the Danish courts, with the City Court of Copenhagen as the agreed venue of first instance, unless mandatory law provides otherwise.
